Daily Jot: The judicial Constitutional crisis

America is facing a judicial crisis where activist Democrat-appointed judges are overreaching their Constitutional boundaries by politically interfering with the Executive Branch’s authority. For example, House Speaker Mike Johnson (R-LA) says that 62% of the federal injunctions issued over the last century were against Donald Trump. And 92% of those were from judges appointed by Democrats. Washington Times Columnist Robert Knight reports that “In Mr. Trump’s first 60 days, Democrats have filed more than 125 lawsuits challenging his policies, many of which involve downsizing the government under the aegis of Elon Musk’s Department of Government Efficiency (DOGE).” Knight says this is the real Constitutional crisis.
Knight reports, “Democrats charge that anything Mr. Trump does constitutes a “constitutional crisis.” But the real crisis is allowing any of more than 677 unelected district judges around the country to cancel the policies of a nationally elected president. The Biden administration’s lawfare against political opponents aided by willing judges badly damaged the judicial system’s reputation. Much of it was aimed at jailing Mr. Trump and preventing his return to the White House. Mr. Trump promised that upon being elected, he would pursue justice, not retribution, and return the justice system to defending constitutional norms. However, what’s happening now in the federal courts is anything but normal. Democrats hope hundreds of legal bee stings will bring down the elephant.”
One example of many is reported by Epoch Times: “U.S. District Judge James Boasberg recently ordered the Trump administration to halt deportations under the 1798 Alien Enemies Act and recalled flights already on their way to El Salvador. As the legal case continues, it has spurred a debate on the authority of the executive branch versus the judicial branch.” Boasberg is an Obama appointee who has a reputation of standing in the gap for leftist interpretations of the law. What is happening here is that the Marxist left of the Democratic Party shops legal challenges around to get the most sympathetic judge and then files for injunctions. Rather than interpret the law as it is written, these judges bend the law to their political beliefs—which former House Speaker Newt Gingrich says is their religion, where they put their faith.
Article III of the Constitution says that “The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior.” Judicial good behavior traditionally means acting in the best interest of the law. Unfortunately, Congress has never removed a federal judge for disagreement with the law’s application or of difference in political views. Federal judges have a wide berth to interpret the law as they see fit. Congress would need to impeach. Judicial activism such as we are seeing has little to do with law and a lot to do with politics, but the Constitution’s remedy is Congress—good luck there, right? Isaiah 59:13 says that justice is far off because of “transgressing and lying against the Lord.” This is happening because these judges religion is Marxism and Congress is inept. And that’s why we have a judicial constitutional crisis.
