Elements of a crime & culpable mental states are necessary for prosecution/Conviction.
I have filed/arrested many ppl for Terroristic Threat & elements are essential. One essential element of that crime is placing a person in fear of Imminent Serious Bodily injury or death.
You have to be specific (ie) "let's go to the Capital & burn that MF down." in order to get inciting a riot.
